Podcast in a Box is operated by Mediabox Solutions LLC, doing business as Podcast in a Box (“PIAB,” “we,” “us,” or “our”).

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use the Podcast in a Box mobile application, related websites, hardware-connected features, support channels, and services (collectively, the “Service”).

For purposes of this Privacy Policy, “User Content” means audio, video, images, text, project files, metadata, names, likenesses, and other material you record, upload, import, create, edit, export, or share through the Service.

1. Information We Collect

A. Information You Provide

We may collect information you provide directly to us, including:

·         Name and email address;

·         Account credentials;

·         Subscription and purchase information;

·         Customer-support messages and attachments;

·         Feedback, survey responses, and communications;

·         Information you submit when requesting assistance, reporting an issue, or participating in a beta program.

B. Recordings and User Content

The Service may process audio recordings, video recordings, images, project files, transcripts, captions, titles, notes, metadata, and other User Content that you create, import, edit, export, or share.

By default, recordings and project files are stored locally on your device unless you choose to export, upload, back up, share, or use a feature that requires transfer or cloud processing.

PIAB does not access recordings stored exclusively on your device.

C. Device, App, and Usage Information

We may collect:

·         Device model, operating-system version, app version, language, and time zone;

·         Device identifiers and diagnostic identifiers;

·         IP address and approximate location derived from IP address;

·         Feature usage, session information, crash reports, performance data, and error logs;

·         Information about connected PIAB hardware or compatible devices, including connection status, firmware version, device type, and technical diagnostic information.

D. Permissions and Device Features

The App may request access to certain device features, including:

·         Camera access, to record video;

·         Microphone access, to record audio;

·         Local-network access, to discover and connect compatible devices used for multi-camera recording;

·         Photos or media-library access, to import media or save and export finished content;

·         Notification access, to send account, subscription, recording, feature, or service notifications.

You can manage most permissions through your device settings. Disabling a permission may limit certain features.

E. Payment Information

If you purchase a subscription through Apple, Google Play, or another authorized payment provider, that provider processes your payment information.

We do not receive or store your full payment-card number.

We may receive limited transaction information, including subscription status, transaction identifiers, purchase date, renewal date, country or region, and product purchased, as necessary to provide paid features and support your subscription.

F. Cookies, Analytics, and Similar Technologies

Our websites and Service may use cookies, pixels, software development kits, analytics tools, local storage, and similar technologies.

These technologies may collect information about device activity, browsing activity, app interactions, pages viewed, feature usage, crash reports, performance, and general location.

We use these technologies to operate the Service, remember preferences, understand usage, troubleshoot problems, improve performance, and protect against fraud and abuse.

You can manage cookies through your browser settings. You can manage certain app-level permissions through your device settings.

2. How We Use Information

We may use personal information to:

·         Provide, operate, maintain, and improve the Service;

·         Create and manage accounts;

·         Authenticate users and prevent fraud or unauthorized access;

·         Process subscriptions and confirm access to paid features;

·         Enable recording, editing, exporting, device connection, synchronization, and project-management features;

·         Respond to support requests and communicate with you;

·         Monitor performance, troubleshoot errors, and improve reliability;

·         Protect the security and integrity of the Service;

·         Enforce our Terms and comply with legal obligations;

·         Send service-related notices, such as billing, security, feature, or policy updates;

·         Send marketing communications where permitted by law and subject to applicable consent requirements.

We do not use identifiable recordings or User Content to train generative AI models unless you separately and expressly opt in.

3. How We Share Information

We may share personal information with:

·         Service providers that help us operate the Service, including hosting, analytics, customer support, security, communications, subscription management, and infrastructure providers;

·         Apple, Google, and other authorized payment providers, to process purchases, validate subscriptions, and provide paid features;

·         Connected or user-directed services when you choose to export, upload, publish, or connect the Service to a third-party platform, cloud provider, podcast host, social-media service, or other destination;

·         Professional advisors, including lawyers, accountants, insurers, auditors, and similar advisors;

·         Parties involved in a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction;

·         Government authorities, law enforcement, courts, or other parties when we reasonably believe disclosure is necessary to comply with law, respond to legal process, protect rights or safety, investigate fraud, or enforce our agreements.

PIAB does not sell personal information.

PIAB does not share personal information for cross-context behavioral advertising.

PIAB does not use or disclose sensitive personal information for purposes other than providing the Service, maintaining security, preventing fraud, complying with law, or other purposes permitted by applicable privacy laws.

4. Sensitive Personal Information

Depending on how you use the Service, we may collect or process information that may be considered sensitive personal information under applicable law.

This may include:

·         Audio recordings that may contain voiceprints, spoken personal details, or other sensitive information;

·         Video recordings that may contain images or likenesses;

·         Approximate geolocation derived from IP address;

·         Account credentials;

·         Any sensitive information you voluntarily include in recordings, support requests, project files, or other User Content.

We use sensitive personal information only as reasonably necessary to provide and secure the Service, fulfill user requests, prevent fraud, comply with law, and maintain the functionality of the Service.

5. Your Recordings and Other People’s Privacy

You are responsible for ensuring that you have the rights, permissions, and consents needed to record, upload, use, export, publish, or share User Content through the Service.

Do not record others without any consent required by law.

If you use the Service to capture another person’s personal information, voice, likeness, or other content, you are responsible for giving any required privacy notices and obtaining any required consent.

6. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy.

Our general retention practices are as follows:

·         Account information is retained while your account remains active and for up to 24 months after account closure, unless a longer period is required by law or necessary to resolve a dispute.

·         Subscription and transaction information is retained for up to seven years to comply with tax, accounting, legal, and reporting obligations.

·         Support communications are generally retained for up to three years after the matter is resolved.

·         Diagnostic logs, crash reports, and usage analytics are generally retained for up to 24 months.

·         Security, fraud-prevention, and access logs may be retained for up to 24 months or longer where necessary to investigate a security incident or comply with law.

·         Locally stored recordings and project files remain on your device until you delete them.

·         PIAB cannot access or delete recordings stored exclusively on your device.

·         If you choose to upload or store User Content through a PIAB-supported cloud feature, we retain that content until you delete it, close your account, or the applicable storage period expires, subject to backup, legal, security, and dispute-resolution needs.

7. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information.

No method of electronic transmission, storage, or security is completely secure. You should protect your devices, account credentials, recordings, and backups.

8. California Privacy Rights

California residents may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, subject to applicable limitations and exceptions.

These rights may include the right to:

·         Know the categories and specific pieces of personal information we collect, use, disclose, sell, or share;

·         Request deletion of personal information;

·         Request correction of inaccurate personal information;

·         Limit certain uses or disclosures of sensitive personal information;

·         Opt out of the sale or sharing of personal information, if applicable;

·         Receive equal service and price even if you exercise your privacy rights.

PIAB does not sell personal information and does not share personal information for cross-context behavioral advertising.

Because PIAB does not sell or share personal information, we do not maintain a “Do Not Sell or Share My Personal Information” link.

If our practices change, we will update this Privacy Policy and provide any required opt-out mechanism, including honoring applicable opt-out preference signals such as Global Privacy Control where required by law.

We will verify your identity before processing certain requests. You may designate an authorized agent to submit a request on your behalf, subject to verification requirements.

We will respond to verified California privacy requests within 45 days, unless we require additional time and provide notice as permitted by law.

Categories of Personal Information We May Collect

In the preceding 12 months, we may have collected the following categories:

·         Identifiers, such as name, email address, IP address, device identifiers, and account credentials;

·         Commercial information, such as subscription and purchase history;

·         Internet or electronic-network activity information, such as app interactions, diagnostic logs, and feature usage;

·         Audio, visual, and electronic information, such as recordings and project content you create or upload;

·         Approximate geolocation information derived from IP address;

·         Sensitive personal information, including account credentials and recordings that may contain sensitive information;

·         Professional or employment-related information only if you voluntarily provide it through support or business communications;

·         Inferences drawn from usage information, such as feature preferences or subscription status.

We collect this information from you, your device, your use of the Service, Apple, Google, other payment providers, and our service providers.

9. Other U.S. State Privacy Rights

Residents of certain U.S. states may have privacy rights under applicable law, including the right to access, correct, delete, obtain a portable copy of, or opt out of certain processing of personal information.

These rights may apply to residents of states including Colorado, Connecticut, Virginia, Texas, Oregon, Delaware, Montana, New Jersey, Nebraska, New Hampshire, Iowa, Indiana, Kentucky, Maryland, Minnesota, Rhode Island, Tennessee, and others as applicable.

If we deny your privacy request, you may appeal the decision by replying to our response and writing “Privacy Appeal” in the subject line. We will review and respond to your appeal as required by applicable law.

10. European Economic Area, United Kingdom, and Switzerland

If you are located in the European Economic Area, United Kingdom, or Switzerland, PIAB processes your personal information under one or more of the following legal bases:

·         Performance of a contract, when processing is necessary to provide the Service, manage your account, process subscriptions, or fulfill your requests;

·         Legitimate interests, when processing is necessary to secure, operate, improve, troubleshoot, and protect the Service, provided those interests are not overridden by your rights;

·         Consent, when required by law, including for certain cookies, marketing communications, or optional features;

·         Compliance with legal obligations, when processing is necessary to comply with applicable law.

You may have the right to request access, correction, deletion, restriction, objection, portability, or withdrawal of consent, subject to applicable law.

You may also have the right to complain to a data-protection authority in your country or region.

PIAB is based in the United States. We may process personal information in the United States and other countries where we or our service providers operate.

Where required, we use appropriate safeguards for international data transfers, including contractual protections approved by applicable data-protection laws.

11. Children’s Privacy

The Service is intended only for individuals at least 18 years old.

We do not knowingly collect personal information from children under 18.

If you believe someone under 18 has created an account or provided personal information to us, email privacy@podcastbox.io. We will take reasonable steps to delete the information as required by applicable law.

12. Third-Party Services

The Service may link to or integrate with third-party services.

Their data practices are governed by their own privacy policies and terms, not this Privacy Policy.

We are not responsible for third-party privacy practices, content, security, or availability.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time.

When we make material changes, we will provide notice through the App, by email, or by another reasonable method.

The “Last Updated” date at the top indicates when this Privacy Policy was last revised.
